Standard Terms and Conditions (T&Cs) for orders placed online at www.glassup.com

We would like to familiarize you below with our standard terms and conditions, which govern how we process and settle your purchases.

The www.glassup.com website offers “GlassUp Srl merchandise” for sale. Sales of GlassUp F4 and kits are allowed worldwide, except for Sweden, Norway, Finland, Denmark, Iceland.

1. Formation of contract and delivery of merchandise

1.1 For orders placed online at www.glassup.com, we enter into English language contracts only. When you order GlassUp merchandise, your contract is with GlassUp Srl, via Ganaceto. 95, 41121 Modena (MO).

1.2 By clicking on “Order now”, you are placing a binding order for the items in your shopping cart. Once you have submitted your order, we will send you an e-mail confirmation of your order no later than 24 hours. A binding contract is formed when you receive the order confirmation from us. If the customer does not receive any confirmation of the order within the term indicated in this art. 1.2., The related order must be considered rejected by GlassUp and, therefore, devoid of effects.

1.3 Please note that, by way of exception, we are under no obligation to deliver your order if our suppliers fail to deliver stock correctly or on time, despite us having followed proper ordering practice at our end (matching purchase transaction). For this exception to apply, we must not be legally responsible for the merchandise being unavailable, and we must have notified you of the situation without undue delay. If merchandise is unavailable, we will refund any payments made by you without undue delay.

2. Prices, shipping costs and express delivery

2.1 The prices set out in the offer as at the date on which the order is placed shall apply. The stated prices are final prices (totals).

3. Payment

3.1 We accept the following payment methods: payment through Paypal and Stripe. We reserve the right not to accept certain payment methods for a given order and to refer to other payment methods

3.2 You consent to receiving invoices and credits solely in electronic form.

4. Statutory right of revocation

When you purchase GlassUp merchandise you have a statutory right of revocation preferably” by providing a justification and by means of any declaration, provided it is explicit, addressed to support@glassup.net  or delivered to GlassUp Srl.

4.1 Information regarding the right of revocation:

You have the right to revoke this contract within 14 days preferably by providing a justification. The period of revocation is 14 days from the day on which you, or a third party designated by you (but who is not the carrier), took possession of the last item of merchandise.

In order to exercise your right of revocation you must notify us (GlassUp Srl, via Ganaceto 95, 41121 Modena (MO), Telephone: +39 0597879243, E-Mail: support@glassup.net) of your decision to revoke the contract by sending us an unequivocal declaration (e.g. a letter sent by post or an e-mail).

In the case of contract relating to multiple goods ordered by the customer in a single order and delivered separately, the period of revocation is 14 days from the day on which you, or a third party designated by you (but who is not the carrier), took possession of the last item of merchandise.

4.2 Consequences of revocation

If you revoke this contract, we are required to refund all payments we received from you without undue delay and at least within 28 days from the day on which we received your notice of revocation of this contract. Refunds will be processed using the same method of payment which you used for the original transaction, unless expressly agreed otherwise with you. We hold off completing your refund until we have received the merchandise back.

You are obliged to return or hand over all merchandise to us without undue delay, but at least within 14 days from the day on which you gave us your notice of revocation of this contract.

You are obliged to return all merchandise:

– securely packaged in their original box, not ruined, damaged or dirty and with all possible accessories, instruction manuals and documentation;

– with the Transport Document (provided with the original box), to allow GlassUp Srl to identify the Customer (Order number, name, surname and address);

– without signs of use, with the exception of those compatible with a normal test of the article.

If all merchandise returned do not comply with the provisions of the previous paragraph, the revocation will not be effective.

The above requirement is deemed satisfied if you return the goods before expiry of the 14-day period. You will be required to pay the return shipping costs. You are only obliged to cover any depreciation in the value of merchandise if the depreciation is attributable to your improper handling of the merchandise when examining its condition, properties and function.

4.3 Revocation form

If you wish to revoke the contract, without prejudice to the possibility for the customer to exercise the right of withdrawal by communicating to GlassUp Srl any other explicit declaration of his decision to withdraw from the contract, the customer can use the following standard text

(*) Delete where applicable

5. Refunds

You consent to receiving invoices solely in electronic form.

5.1 Any refunds are paid automatically to the account you used for payment.

7. Statutory liability for defects and further information

7.1 The relevant statutory provisions govern our liability for defects.  Should you have any issues or wish to make a complaint directly to GlassUp Srl, you may contact us.

8. Applicable law

8.1 As a customer, you have the option to contact a local ADR organ in the event of any dispute which you have been unable to settle directly with GlassUp Srl. You can use the ADR to try to reach an out-of-court settlement, which usually is easier, quicker and cheaper than initiating a legal action in court. Please, however, note that the possibility to use ADR is available only if you live within the EU and the trader is based in the EU. You can submit your complaint to the EU’s online dispute resolution platform at www.ec.europa.eu/odr.
